These Terms of Use and General Conditions apply to the use of Painel's services. Any customer who meets the requirements of this term and wishes to purchase any product sold on the Painel website must read and accept this term, which is submitted to every new user at the time of registration. By clicking on? I have read and agree to the TERMS OF USE? The user declares that he/she has read, understood and accepted all the clauses of this term. In addition, internal orders or orders sent by customers by e-mail directly to our sales center will also be subject to the requirements of this term, in accordance with the clauses below:
Painel will make every effort to keep the information and materials contained on this site as accurate, up-to-date and complete as possible. However, Painel will not be held responsible for the use, application or processing that ?internet users?, clients and/or users may give to said information.
The terms described below, when used in these Terms and Conditions, shall have the following meanings:
(a) Internet user(s): all those who in any way access the site, whether customers or not;
(b) Customer(s): all persons who have purchased the products offered by the Panel, whether paid or not.
(c) User(s): all persons who register on the site and receive an individual and exclusive access account.
In order to complete their purchase, users must register on the site. The user must fill in all the required fields with accurate and truthful information and is responsible for updating the registration information whenever any changes occur.
Minors and people considered legally incapable of performing the acts of civil life may not register. Acts and purchases made by them will be considered null and void. Therefore, the user declares to be over 21 (twenty-one) years of age or to be expressly authorized by their parents or guardians. When registering, the user must provide true, up-to-date and complete information, as requested in the registration forms, and keep their data updated accurately and completely whenever requested. Painel will cancel the registration, without prior notice, if it discovers that the user has provided false or misleading registration information. (The user is legally responsible for the veracity and authenticity of the information provided on the site, exempting Painel from any liability in this regard. If Painel finds any inaccuracy in the information provided by the user or illegality in their conduct, it may, at its sole discretion, suspend or cancel the corresponding access account. This measure, however, does not cease or diminish the user's responsibility for the accuracy and veracity of the data they provide).
When registering, the user will create a ?password? which will be their personal identification for accessing the services offered. If you forget your password, simply enter your registered e-mail address and Painel will send you an e-mail to re-register a new password within a few minutes. The user is entirely responsible for the confidentiality of their password. (Purchases made by children under the age of eighteen (18) under their guardianship are the responsibility of the user). The same person may not have two or more registrations with the site. The site may prevent the second registration by cross-checking the personal data provided, if it still has it in its database. By registering, the user agrees to the sending of advertising material by Painel or partners to the contact and e-mail addresses.
After logging in to the site, purchases will be made via the ?shopping cart?. The inclusion of a product in the ?shopping cart? does not guarantee its purchase. In the event that the product is out of stock between inclusion in the ?shopping cart? and finalization of the order, the out-of-stock product will automatically be removed from the order and the purchase relating specifically to the out-of-stock product will be made impossible.
In the event of simultaneous purchases of a product with only one (1) unit in stock, the first confirmed order will reserve that product in stock. The second order will therefore not be able to be completed for the same product. Users must take care of their login details, as they are personal and non-transferable, never disclosing them to third parties and keeping their computer equipment protected with up-to-date software, up-to-date antivirus software and state-of-the-art firewalls. These measures are essential for making a secure purchase. Painel reserves the right to cancel purchases in exceptional cases such as:
(a) Unavailability of the product in our stock. In Internet sales it is impossible to predict the number of orders that will be placed throughout the day for each item in our range, so orders will only be accepted once we have confirmed that the product is available in our stock. Before canceling, the company will contact you by e-mail or telephone offering a new delivery date.
(b) The purchase is not approved by our finance department or credit card company. Before canceling, the company will contact you by e-mail or telephone offering another payment option.
(c) Non-payment of the boleto bancário. If the boleto is not paid by the due date, the purchase will be automatically canceled.
(d) Data does not match or is missing. If the data provided by the customer is not confirmed, the customer will receive a warning via e-mail and may contact us to provide new data or even change the data already sent. If the customer does not return the call and confirm the information, the purchase will be canceled.
Painel reserves the right to correct possible errors in relation to the prices published in general media campaigns. All prices and promotions are subject to stock availability and last for a limited time. The inclusion of a product in the shopping cart does not guarantee the price of the product. In the event of a price change between inclusion in the shopping cart and finalization of the order, the price in force at finalization of the purchase will prevail. Therefore, users and customers must observe the price at checkout.
The credit card numbers provided by the user will be registered directly in the card companies' database, so the shopkeeper will not have access to this information. On receiving the card details, the card company will verify the transaction online, at which point it will inform the user whether or not the purchase has been cleared. 6th LIABILITY AND DAMAGES
Painel is not responsible, expressly or tacitly, for the improper use of the information, instruments, materials made available and/or equipment used by this site, for whatever purpose, made by any internet user, client and/or user. The proper use of all Internet resources, without exception, is the sole responsibility of Internet users, clients and/or users of the site.
Painel is not responsible for the content of other websites whose addresses are available on the pages of this site, nor is it responsible if the address of this site is available on other websites. Painel is not responsible for the content of sites accessed via hyperlinks and does not participate in their creation, nor does it have any control over their content. Access to such pages is at the user's own risk. Painel does not guarantee compensation for any damage caused by any website.
Painel shall not be liable and hereby disclaims all liability for any consequential, contingent, indirect, special, punitive or incidental damages whatsoever, including without limitation, loss of profits, use, business or revenue, even if it has been advised of the possibility of such damage and regardless of the legal theory evaluated, including warranties, contractual liability, negligence or strict liability.
The Panel's liability for direct damages shall in no event exceed the price paid by the customer for the products that resulted in the claim for direct damages. No penalty clause contained in any document shall have effect vis-à-vis Painel unless it has been expressly accepted in writing by a legal representative of Painel.
Painel warrants to customers, for a period of one (1) year after the date of delivery, that all products sold to the customer shall comply with their applicable specifications, as may be stated in the technical description of the product. If, after Panel has received written notice, during the warranty period provided for herein, any product fails to comply with Panel's respective specification, and in Panel's sole discretion, Panel determines that such claim is valid, Panel's entire liability shall be, within a reasonable time after Panel's receipt of such notice, at Panel's option, to repair or replace such product, and Panel shall be responsible for the costs of shipments of the parts to be repaired or the unit to replace the defective product.
Repaired products may be used to repair or replace products and the warranty on such repaired or replaced products shall be the balance of the remaining warranty on the products that have been repaired or replaced.
In no event shall the Panel be required to accept delivery of any defective product returned to it without its prior authorization, including the means, transport and loading route of such return.
Under no circumstances will credits be allowed for unauthorized rework on any materials. Except for Panel's warranty of title to the products, Panel expressly disclaims and excludes all other warranties whatsoever, express or implied, including without limitation, warranties of merchantability and fitness for a particular purpose or any warranty arising out of course of dealing or usage of trade.
Painel's obligation does not cover defects and losses caused by normal use or wear and tear or deterioration, defect in, or damage to, any products resulting from improper installation, accident or any use, maintenance, repair or modification of the products not consistent with Painel's instructions or the designated capabilities of the products or that, in its sole judgment, the performance or reliability thereof is thereby adversely affected, or is subject to abuse, mistreatment, misuse or neglect or any damage caused by connections, interfaces or use in unforeseen or undesirable environments.
Painel does not warrant that the operation of the products will be uninterrupted or error-free, or that the functions of the products will meet the customer's requirements, or that the products will operate in conjunction with other products chosen for their use by the customer. Painel assumes no responsibility for equipment or services provided by the customer or its customers, nor does this warranty cover any copying or updating of any user manual for the products.
If Painel is requested to repair any products not covered by its warranty, such repair shall be made at the expense of the person requesting such repair, unless otherwise specifically authorized by Painel in writing. No alteration or modification of the products by anyone other than Painel will be permitted without specific written authorization from Painel, and such act will invalidate the product's warranty and Painel will not accept a return of the product.
Important:
-During the warranty period you should only use Painel services. If you use other services that are not accredited by the manufacturer, you risk losing your right to the warranty.
-All products sold on the Painel website are guaranteed for 1 year against manufacturing defects; misuse of parts or misapplication will not be covered. To be entitled to the guarantee, you must keep the certificate and the purchase invoice.
Painel reserves the right to prevent abuses of rights committed by users in bad faith, or attempted fraud, in cases where the user places successive purchase orders without the respective confirmation of payment, in a quantity greater than 90% of the orders placed, within a period of 60 (sixty) days. In this case, the Panel may, in its regular exercise of rights, block these users, preventing them from placing new purchase orders, in order to guarantee the regular supply of products and prevent the stock of products from being blocked, harming consumers in good faith. If the blocked user is interested in placing new purchase orders, they should contact the call center.
9TH VERACITY OF INFORMATION
Painel reserves the right to check the veracity of the information provided by consumers, such as: name, CPF and other registration data. Consultations may be made on the website of the Federal Revenue Service and credit risk analysis systems. If any discrepancy is found between the information provided when registering on Painel's website and that observed in consultations of the Internal Revenue Service's systems, the user's/customer's purchase order may be canceled, upon notice by registered e-mail, in order to curb attempted fraud or abuse of rights committed by consumers in bad faith.
This site contains texts, photographs, images and tables that are protected by copyright or other intellectual property rights. Unless otherwise stated, all the contents of the pages of this website belong to Painel or have been granted under license by their owners, in such a way that Painel may use this material as part of this website.
By accessing the Painel website, the internet user, client and/or user declares that they will respect all intellectual and industrial property rights, those arising from the protection of trademarks, as well as all rights relating to third parties that may be or have been, in some way, available on the website. Simple access to the site does not grant the internet user, client and/or user any right to use the names, titles, words, phrases, trademarks, patents, designs, models, photographs, among others, that are or have been available on it.
The reproduction of the content described above is prohibited, except with the prior written authorization of Painel (All and any content on the Painel website, such as texts, graphics, images, tables and icons, are the property of Painel and are protected by the Copyright Law. Painel does not authorize the use of its name or brand, and no advertising is allowed unless expressly authorized and after due negotiation).
The customer is aware and agrees that any trademark, trade name and logo of Painel and its goodwill associations are the exclusive property of Painel. Through the sale of products to Customer, Panel does not grant Customer any right to use the Panel Marks, whether or not in connection with the resale of the products, unless expressly permitted in writing by Panel. Customer will not advertise, promote, market or package any product in a manner that is likely to dilute, disparage, or cause confusion with respect to any Panel Mark. Customer will not use Panel's name in its promotional or advertising materials or assert affiliation with Panel or any affiliate of Panel unless expressly agreed to in writing by Panel in each case. The customer will not at any time contest the validity of any Panel Mark, request any rights in any Panel Mark or do anything which, in the opinion of the Panel, may disparage, confuse or diminish the importance of any Panel Mark.
Painel may at its sole discretion and without incurring any liability to the customer:
(a) change the specifications for, or make any design or engineering changes to, any product;
(b) discontinue the manufacture or sale of any product;
(c) discontinue the development of any new product, whether or not such products have been publicly announced;
(d) commence the manufacture or sale of a new product having characteristics that make any products obsolete, in whole or in part.
Notwithstanding the foregoing, Painel shall fulfill all orders accepted from the customer for any such changed or discontinued products of which manufacturing or commercial deliveries have commenced. The customer may ask Painel to change the specifications of any product. If Panel accepts this request, the parties will negotiate any resulting change in the price of the products or other applicable terms and the customer will pay for any raw materials, work in progress and/or finished products that become obsolete as a result of changes.
Any definition resulting from such change shall affect only those orders issued after the effective date of such change. Unless otherwise agreed in writing by the Panel. All tests and special inspections of the products requested by the customer will be carried out at the customer's expense at Painel's factory, or at a laboratory exclusively chosen by Painel.
When a product is out of stock, the user can choose to receive a Notification by e-mail or telephone. By providing their details, they authorize the Panel to contact them when the item is back in stock. When the e-mail is sent, there is no guarantee that the stock will be available, as the system automatically sends it to all the people who have requested the notification and a customer may buy the item before another customer sees the e-mail.
It is important to note that the delivery time is counted from the moment the payment for the item is confirmed (cash sale by boleto or bank transfer, credit card via PagSeguro or BNDES card). For sales with approved billing via boleto with bank collection, the order will be released for manufacture once the customer's official purchase order has been sent to Painel. Some situations may alter the delivery time, such as: inconsistency in the data provided at the time of purchase, refusal to receive the goods by a third party, absence of a person responsible for receiving the product at the place of delivery, natural factors such as rain, accidents, strikes, among others. Should any of these situations occur, our customer service team will contact you to inform you of any occurrence. It is very important to provide valid contact details and telephone numbers to make this possible.
The delivery time for our products is an average of 9 working days for collection from the Panel's physical address. This period may change due to the availability of items in our stock or production, and may be longer or shorter than the period provided here. Orders placed on Painel's website must complete the purchase with FOB shipping and indicate the carrier later via email to painel@painel.ind.br or by telephone (16) 3626-1966. The customer is fully responsible for contracting the FOB freight service (amount to be paid, delivery time, payment terms and other commercial conditions).
In the case of CIF freight, a method only and exclusively agreed with Painel via e-mail (CIF freight method not available for online purchases), delivery will be made according to the criteria of the carriers, and the product will be left with the recipient at the gate, gatehouse, sidewalk or similar, and under no circumstances will the carrier be responsible for taking the product inside the building, shed, hall or any other property where the recipient is located. The customer is responsible for receiving, unloading and handling the product to its storage location.
Painel shall not be liable for any loss or damage resulting from any delay or failure in delivery arising from the customer's actions, acts of God or force majeure, including without limitation, fires, floods, accidents, strikes, slowdowns, wars, embargoes, governmental priorities, orders or restrictions, transportation delays, equipment failure, delays by any material or parts supplier, inability to obtain necessary labor, or other causes beyond Painel's control. If any such delays occur, the delivery date shall be extended by the period equivalent to the time lost by reason of such delay. If an event of customer action, acts of God or force majeure prevents or delays, for a period exceeding 6 months, the performance by Panel of an order accepted by Panel, either party may terminate, without penalty, the order accepted by Panel and adversely affected by such event, by giving written notice of such decision to the other party.

The payment method is chosen when the order is finalized. The payment options will be shown as soon as you click on the FINISH link in the shopping cart.
Payment can be made in cash by boleto / bank transfer or in installments by credit card via PagSeguro (UOL) in up to 18x. The order is subject to approval by the credit card company. To further enhance your security, the information contained in your registration is subject to confirmation, which may be requested by Painel by e-mail and/or telephone. The security of purchases on our site is guaranteed by PagSeguro, the billing system of the renowned company UOL (www.pagseguro.com.br), which guarantees the customer's money back in the event of a problem with the purchase. However, Painel is not responsible for approving bank transactions, so in the event of a cancellation or problem with the payment, please contact PagSeguro directly. After making a request to purchase products in the online store, the user must wait to receive notification via e-mail in which they will be informed of the confirmation of the commercial transaction requested (Purchase and Sale).
Purchases can also be paid in installments using the BNDES card with fixed monthly installments of up to 48 months. The interest rate is set monthly, based on the forward rate published by ANDIMA (National Association of Financial Market Institutions), calculated on the basis of the National Treasury Bills, and is available and updated on the BNDES Card Operations Portal.
Optionally, payment can be invoiced via boleto with bank collection, subject to registration approval by Painel's Credit Department. Valid only for Legal Entities with at least 1 year of commercial activity. The result of the evaluation of the registration is given in approximately 1 working day, after the approval of the analysis of the Credit Sector. The client must send the following list of documents to the Credit Department via e-mail (painel@painel.ind.br): Registration form; Copy of the articles of association or bylaws; Last amendment to the articles of association or bylaws; CNPJ card; Up-to-date bank and commercial references; If the company has any protests, send a letter of consent.

Important:
- Before completing your purchase, please check your order details, payment method and delivery address. It will not be possible to change them after checkout.
- Payment by credit card may not be approved if the cardholder's details are not correct. The boleto bancário generated for payment will be valid for 03 (three) days and will be automatically canceled once this period has elapsed.
15th EXCHANGES AND RETURNS
Products with manufacturing faults or defects may be exchanged provided that the request is made within the legal warranty period counted from receipt of the products, taking into account the following occurrences:
Repentance
According to article 49 of the Consumer Protection Code, in purchases made outside the commercial establishment, the consumer has up to 7 (seven) calendar days to regret the purchase and communicate the withdrawal to the supplier.
The right of withdrawal leads to the purchase being undone and, just as the consumer has the right to a refund of the amounts paid, the supplier has the right to receive the product intact, in a condition to be sold again, with no signs of use or damage to the product, its components or packaging being allowed.
In the event of cancellation of the purchase due to regret, the amount paid by the customer will be fully refunded as described in the Refunds section.
Damage in transit
Upon receipt, check that the packaging has not been damaged and that the product has not been damaged. Painel will not be held responsible for any damage to the product resulting from transportation using FOB freight, where all freight services and the amount paid are the responsibility of the customer. In this case, if the product is damaged, the customer must contact the contracted carrier for compensation for the damage caused to the material.
For deliveries with CIF freight (agreed in advance and only by e-mail), if the product is damaged during transportation, refuse receipt and contact Customer Service within 72 hours via e-mail: painel@painel.ind.br.
Defective Product
If the product has a manufacturing defect, notify the Panel within 90 (ninety) calendar days of receipt of the product, and the exchange/return procedure will follow the provisions of the Consumer Defense Code. If the product is not repaired within 30 (thirty) days, the customer may choose between the following alternatives:
(a) replacement of the product with an identical one;
(b) a refund of the amounts paid by the customer as described in the Refunds section.
If the customer has already received the defective product, the procedure will be to send a photo of the damaged product in the state in which it arrived immediately to painel@painel.ind.br. Further information on the exchange and returns procedure can be found on the EXCHANGES AND RETURNS link available on the website, which is also included in these Terms of Use.
Important:
- In the event of a manufacturing defect, the product will be picked up by Painel, or its contracted carrier, at the same address as the delivery.
These Terms and Conditions may be revised, modified and/or updated at any time, unilaterally by Painel and without prior notice, so that the most up-to-date version will always be available on the website. Therefore, internet users, clients and/or users should check them in advance each time they visit the site. If they continue to access the site after the revisions come into force, even if not notified, it is understood that they agree to follow the revised, modified and/or updated Terms and Conditions.
